SMS Consent

1. Who We Are

Buildalytic is a construction operations software platform serving general contractors, subcontractors, and construction management companies across the United States. We operate as an Independent Software Vendor (ISV) and send SMS messages on behalf of our client construction companies to the field reporters those companies enroll.

Every SMS message sent through the Buildalytic platform is strictly operational. The originating business in any SMS interaction is the construction company that employs the recipient. Each client company operates on its own dedicated phone number. Messages from different companies are never co-mingled on the same number.

2. Who Receives Messages

Recipients are field reportersat our client construction companies, namely superintendents, project managers, and foremen who file daily field reports for their employer. A reporter's mobile number is their identity on the platform; there is no app or login.

Reporters are enrolled by their own company, not by Buildalytic. The company's owner or operations lead, who is the authorized Buildalytic account administrator, sets up daily reporting and enrolls the reporters who will participate.

3. Types of Messages

All messages are operational. We do not send promotional or marketing messages.

• Daily Report Reminders: A reminder when a reporter's daily field report for the workday has not yet been submitted.
• Report Confirmations: Confirmation that a daily field report was received and recorded.
• Photo & Update Replies: Confirmation and follow-up when a reporter texts in a job-site photo or a written update for their daily report.
• Missed-Report Recovery: If a reporter misses their scheduled daily-report call, a single follow-up text inviting them to file by reply.
• Opt-In Request: A one-time message, sent when a company enrolls the reporter, asking them to reply YES to confirm. No other message is sent unless they reply YES.
• Opt-In Confirmation: A one-time confirmation sent right after the reporter replies YES, with frequency, rate, and opt-out disclosures.

4. How Consent Is Collected

Consent is always a confirmed opt-in, collected in one of two ways. First, a reporter can opt in themselves through Buildalytic's SMS opt-in form, where they enter their own mobile number and check an unchecked consent box that states the message types, that message frequency varies, that message and data rates may apply, and how to get help or opt out. Their submission is the opt-in, and Buildalytic sends a single confirmation text.

Second, when a company's authorized administrator adds a reporter's mobile number to set up daily reporting, that reporter receives a single opt-in request and must reply YES to confirm before any operational message is sent. In both cases the consent is stored with a timestamp, is for operational work-related messages only, is never a condition of any purchase, and any reporter can opt out at any time by replying STOP, which immediately suppresses all further messages to that number.

6. Message Frequency

Message frequency varies based on a reporter's reporting schedule and job-site activity. Reporters typically receive a few messages per week during active project periods. No recurring promotional messages are ever sent.

7. Message and Data Rates

Message and data rates may apply, depending on your mobile carrier plan. Buildalytic does not charge recipients for SMS messages. Carrier fees are determined solely by your wireless service provider.

8. How to Opt Out

You can opt out of all SMS messages at any time. Opt-out requests are processed immediately.

• Reply STOP to any message. You will receive one final confirmation and then no further messages.
• Tell your company administrator and ask to be removed from daily-report messaging.
• Email us at support@buildalytic.com with your name and phone number.

10. No Sharing of Phone Numbers

Phone numbers collected for SMS messaging are never sold, rented, or shared with third parties or affiliates for marketing or promotional purposes at any time. Text-messaging originator opt-in data and consent are not shared with any third parties. Numbers are used exclusively to deliver the operational daily-reporting messages described in this policy.

11. Platform Architecture

Buildalytic operates as an Independent Software Vendor (ISV). Each construction company sends messages to its own enrolled reporters under its own business identity using its own dedicated phone number.

Messages from different construction companies are never co-mingled on a single number. If you receive a message, it originates exclusively from the construction company that enrolled your phone number in their Buildalytic account.

12. Privacy

All phone numbers and SMS consent data are handled in accordance with our Privacy Policy and Terms of Service. We implement industry-standard security measures including encryption in transit and at rest. No personal data collected for SMS purposes is used for advertising, sold to data brokers, or shared beyond what is described in this policy.
