SMS Consent & Opt-In Policy

Summary: Buildalytic is an AI-powered construction operations platform. We send SMS messages on behalf of construction companies to their employees and field crews for scheduling, dispatch, and operational notifications only. No marketing messages are ever sent. Recipients can opt out at any time by replying STOP to any message.

1. Who We Are

Buildalytic is a construction operations software platform serving general contractors, subcontractors, and construction management companies across the United States. We operate as an Independent Software Vendor (ISV) — we send SMS messages on behalf of our client construction companies to their own employees and field workers.

Every SMS message sent through the Buildalytic platform is strictly operational. The originating business in any SMS interaction is the construction company that employs the recipient — Buildalytic is the technology infrastructure that delivers those messages. Each client company operates on its own dedicated phone number. Messages from different companies are never co-mingled on the same number.

2. Types of Messages We Send

All messages sent through Buildalytic are operational. We do not send promotional or marketing messages. Message categories include:

  • Crew Scheduling: Weekly schedule assignments, shift start times, job site locations, and foreman contact information.
  • Dispatch Notifications: Same-day or next-day job dispatch alerts including site address, equipment requirements, and crew lead details.
  • Schedule Changes & Alerts: Notifications of job site changes, weather delays, schedule conflicts, or shift cancellations.
  • AI Receptionist Follow-Up: When an inbound caller interacts with a company's AI receptionist and verbally consents to receive a text, a single follow-up SMS is sent with the company's contact information and next steps.
  • Account & Operational Notifications: Onboarding confirmations, document requests, and operational alerts for company administrators.

3. How We Collect Consent

Buildalytic collects opt-in consent through two methods depending on the context. Consent is always affirmative, informed, and documented before any message is sent.

3a. Verbal Consent — Employee Onboarding & AI Receptionist

When a construction company onboards field workers verbally — during a job site briefing, onboarding meeting, phone call, or dispatch conversation — the following scripts are used to obtain explicit consent. Administrators and foremen are trained to follow these scripts exactly and to record the consent interaction in the Buildalytic platform.

Script A — Crew & Employee Onboarding

ADMIN / FOREMAN SAYS:

“As part of working with [Company Name], we send text message notifications to keep you updated on your crew schedule, dispatch assignments, job site locations, and any shift changes. You will typically receive between 3 and 10 messages per week depending on scheduling activity. Standard message and data rates may apply depending on your mobile carrier plan. You can opt out at any time by replying STOP to any message, or reply HELP for assistance. Do you consent to receive these text messages from [Company Name]?”

EMPLOYEE RESPONDS:

“Yes.”

ADMIN / FOREMAN CONFIRMS:

“Thank you. You are now enrolled. You will receive a confirmation text message shortly to the number on file. Reply STOP at any time to unsubscribe.”

Script B — AI Receptionist Inbound Caller

AI RECEPTIONIST SAYS:

“Thank you for calling [Company Name]. To send you a follow-up text message with our contact information and next steps for your inquiry, we need your consent. Standard message and data rates may apply. You can reply STOP at any time to stop receiving messages. Do you agree to receive a follow-up text message from [Company Name]?”

CALLER RESPONDS:

“Yes.”

AI RECEPTIONIST CONFIRMS:

“Thank you. You will receive a text message at this number shortly. A team member from [Company Name] will follow up with you within one business day. Reply STOP at any time to unsubscribe.”

How verbal consent is recorded

When a company administrator enters an employee's phone number into the Buildalytic platform, they confirm that verbal consent was obtained using the approved script. This action is logged with a timestamp, the administrator's user ID, and the consent method. Records are retained for a minimum of 4 years in accordance with CTIA Messaging Principles and Best Practices.

3b. Text-Based Opt-In Confirmation (VIA_TEXT)

When a foreman or administrator adds a worker's phone number to the Buildalytic scheduling system, the worker receives a one-time opt-in confirmation text before any further messages are sent:

No further messages are sent until the worker replies YES. The confirmation reply is logged with timestamp and stored as the consent record. Workers who reply STOP or do not reply receive no further messages.

4. Opt-In Confirmation Message

Upon successful enrollment, recipients receive the following confirmation message:

AI Receptionist Follow-Up

Husky Builders: Thanks for calling. A team member will follow up within 1 business day. Questions? Call us at (916) 555-0100. Reply STOP to opt out.

Schedule Change Alert

Whitaker Construction: Update — tomorrow's shift at Site B is delayed to 8:00 AM due to site inspection. Contact your foreman with questions. Reply STOP to opt out.

6. How to Opt Out (STOP)

You can opt out of all SMS messages at any time. Opt-out requests are processed immediately and no further messages will be sent.

  • Reply STOP to any message. You will immediately receive one final confirmation and then receive no further messages.
  • Contact your company administrator and ask to be removed from the messaging list.
  • Email us at raja@buildalytic.com with your name and phone number.

8. Message Frequency

Message frequency varies based on scheduling activity and the operational needs of each job site. Field workers and crew members typically receive 3–10 messages per week during active project periods. AI receptionist follow-up messages are single, one-time messages sent per inbound call interaction where consent was obtained. No recurring promotional messages are ever sent.

9. Message & Data Rates

Standard message and data rates may apply depending on your mobile carrier plan and data package. Buildalytic does not charge recipients for SMS messages. Any carrier fees are determined solely by your wireless service provider. Contact your carrier for details about your plan's messaging rates.

10. No Sharing of Phone Numbers

Phone numbers collected for SMS messaging are never sold, rented, or shared with third parties for marketing purposes. Numbers are used exclusively for delivering the operational notifications described in this policy and for no other purpose. This applies to both Buildalytic and all construction companies using the Buildalytic platform.

11. Platform Architecture — ISV Notice

Buildalytic operates as an Independent Software Vendor (ISV). Each construction company using the Buildalytic platform sends messages to its own employees under its own business identity using its own dedicated phone number. Buildalytic provides the technology infrastructure — the originating business in any SMS interaction is the construction company that employs the recipient, not Buildalytic.

Messages from different construction companies are never co-mingled on a single number. If you receive a message, it originates exclusively from the construction company that has added your phone number to their Buildalytic account.

12. Consent Record Retention

Buildalytic retains records of all consent interactions for a minimum of 4 years in accordance with CTIA Messaging Principles and Best Practices. Consent records include: the enrolled phone number, timestamp of enrollment, method of consent (verbal confirmation or text reply), the company administrator who initiated enrollment, the consent language delivered, and a log of any subsequent opt-out events. All records are stored securely and accessible for compliance review upon request.

13. Privacy

All phone numbers and SMS consent data are handled in accordance with our Privacy Policy. We implement industry-standard security measures including encryption in transit and at rest. No personal data collected for SMS purposes is used for advertising, sold to data brokers, or shared beyond what is described in this policy.
